- [เรื่องต้องรู้ เมื่อจะนำเข้า หรือส่งออก / เมื่อพิกัดศุลกากร (HS CODE) ผิด ตอนที่ 1](https://www.transpeed.biz/%e0%b9%80%e0%b8%a3%e0%b8%b7%e0%b9%88%e0%b8%ad%e0%b8%87%e0%b8%95%e0%b9%89%e0%b8%ad%e0%b8%87%e0%b8%a3%e0%b8%b9%e0%b9%89-%e0%b9%80%e0%b8%a1%e0%b8%b7%e0%b9%88%e0%b8%ad%e0%b8%88%e0%b8%b0%e0%b8%99-5/): เราเคยพูดถึง     ไปกันแล้วนะคะ  ในบทความนี้เรายังคงให้ความสำคัญกับพิกัดศุลกากร ว่าเราควรตรวจสอบให้ถูกต้อง เพื่อจะได้เสียอากรในอัตราที่ถูกต้อง  เพราะเคยมีเคสของผู้ประกอบการ ที่มีเจ้าหน้าที่กรมศุลกากรมาตรวจสอบการนำเข้าย้อนหลังทำให้ทราบว่า ที่นำเข้าวัตถุดิบตลอดหลายปีที่ผ่านมา พิกัดที่สำแดงมาตลอดเป็นพิกัดที่ผิด  เพราะพิกัดที่สำแดงเสียอากรขาเข้าแค่  10% ในขณะที่พิกัดที่ถูกต้อง  ต้องเสียอากรขาเข้า  20%  ซึ่งตรงนี้ผิดกฏหมายศุลกากร  เพราะเป็นความผิดฐานหลีกเลี่ยงภาษี  และอาจจะเข้าข่ายความผิดฐานสำแดงเท็จอีกด้วย  ซึ่งเราไม่สามารถกล่าวโทษได้ว่าทำไมเจ้าหน้าที่ไม่แจ้งตั้งแต่ต้น   ปล่อยให้เกิดความผิดเช่นนี้มายาวนานได้อย่างไร  และที่สำคัญต้องชำระเงินค่าอากรส่วนต่างพร้อมค่าปรับ  รวมถึงค่าใช้จ่ายอื่นๆที่เกิดขึ้น  ซึ่งบางครั้งสูงจนแทบกิจการอาจล้มละลายเลย
